The French multinational corporation provides custodial and food services to seven Central Jersey school districts. Several workers in South Plainfield, however, said they were threatened to be fired for organizing a union. The National Labor Relations Board general counsel said it has authorized a complaint against Sodexo after finding probable cause that a supervisor told workers that certain employees engaged in union activity would be fired if Sodexo won a new contract with the district. The contract is up next year, according to the South Plainfield Board of Education. The state Department of Labor is investigating whether Sodexo failed to provide former custodial employees in the Highland Park school district with a prevailing wage. On June 20, the Highland Park Board of Education terminated its contract with Sodexo early because of the prevailing wage and other issues, said Wendy Saif, former board president. It awarded a $2.2 million contract to Temco Facility Services, and workers now are unionized, which they said they were discouraged from doing by Sodexo. “If this union wants to organize the people who work for Sodexo in South Plainfield they should do so,” she said. “The SEIU is using South Plainfield and Highland Park as stalking horses in their effort to unionize the entire company. If they have the workers’ best interests at heart, they would hold the ratification vote now. That way, they would be the legitimate voice of these people. What they are doing at present is nothing more than exploiting these people for their own ends. It is my opinion that they could care less about the people in South Plainfield. What they are interested in is the publicity they can generate for their ultimate goal, that of unionizing the entire company.

The great debate on the minimum wage continues to dominate the employment landscape in Malaysia.

Yesterday’s tabling of the National Wage Consultative Council (NWCC) bill drew mixed reactions from two main blocks: those who are fighting for it, and those who are on the opposing divide. Both are kept at loggerheads. The bipartisan, on the other hand, are waiting with great interest for the next developments.

This NWCC is, by the nature of its roles, is not an authoritative indication that the minimum wage policy will come into practice too soon. Members appointed to form the council, who come from the various parts of bodies, will be assigned to carry out all the necessary study, evaluation and assessment on a wide range of sectors before recommending the appropriate minima salary levels for the sectors. The government will then decide if it wants to proceed.

It does not take an Albert Einstein to figure out that with the tabling of the NWCC, the government is still in the “thinking mode” and that it wants to buy some time before making a decision that may possibly change the course of the manpower acquisition practice in the country.

A few proponents of the regulation see NWCC as a stumbling block to the implementation of a nationwide minimum wage regulation. What they want is this new salary policy to come into place on immediate basis, without having to go the seemingly unnecessary bureaucracy. In contrast, those who are in favor of minimum salary see this as their ‘last immediate chance’ to fight. For them, it ain’t over until the fat lady sings.

THE PROS:

1. More respect, less exploitation by employers.

Without the salary floor, irresponsible employers may resort to determining the worker’s salary according to their whims and fancies. Worse, they may seasonally adjust the wage depending on the prevalent business situation. When business is good, they pay more. When it is bad, they pay less. This is blatant abuse to the labor market and to the workers. It’s totally responsible.
